Welcome to Renovating Moms, an online platform like minded women who connect on everything related to renovations and the home . We connect home owners with service providers and with each other to inspire, connect and share supporting each other to improve one of their biggest financial and emotional investments – their homes.  

These Terms of Use (the “Terms” or the “Agreement“) set forth the binding legal agreement between you and Renovating Moms. The Agreement governs your use of www.renovatingmoms.com and all of the related websites, Facebook pages, products and services offered by Renovating Moms, including our plug-ins and browser extensions (collectively, the “Renovating Moms Platform“).

These Terms provide important information to you, including your agreement to resolve any disputes by individual arbitration and to waive the right to participate in any kind of class action. The Terms also cover your agreement to grant us rights to your content, our limitation of liability to you and, if you choose to provide us with your phone number or email address, your agreement to receive calls, text messages or emails from us in accordance with applicable laws of the Republic of South Africa.

We encourage you to review this Agreement carefully. By accessing or using the Renovating Moms Platform in any way, including browsing www.renovatingmoms.com, you are agreeing to these Terms in their entirety. If you do not agree to any of the Terms, you may not use the Renovating Moms Platform.

1.1. Using the Renovating Moms Platform.

• Who can use it? You must be at least 18 years of age to use the Renovating Moms Platform. Use of the Renovating Moms Platform by anyone under 18 years of age is strictly prohibited!
• Registration. Access to certain functionalities of the Renovating Moms Platform will require you to register with us and to create a profile on our Platform. If you register with Renovating Moms, you agree to provide us with accurate information and update it as needed for accuracy. We will treat personal information you provide as part of registration in accordance with our Privacy Policy. You also may have the option to register for an account by linking your Facebook or Google account.
• Privacy Policy. Our privacy practices are set forth in our Privacy Policy. By using the Renovating Moms Platform in any way, you understand and acknowledge that the terms of the Privacy Policy apply to you, regardless of whether you have created an account on Renovating Moms.
• Profile for Professionals. If you are a professional services provider, you may set up a Professional Profile. If you do, you give us the right to list your Professional Profile in our Renovating Moms Platform, and you will be able to connect with others on the Renovating Moms Platform while identified by your professional profile.
• Acceptable Use. When using the Renovating Moms Platform, you agree to abide by Renovating Moms rules of conduct, common standards of etiquette and act in accordance with the applicable law.
• Prohibited Products. If you are a professional, vendor, or seller, who is authorized to offer products through the Renovating Moms Platform, you agree to abide by the laws regarding the sale or offering of services governing the prohibition of certain products and services.
• Termination. You may close your account at any time by going to account settings and deactivating your account. We may permanently or temporarily suspend your use of the Renovating Moms Platform at any time for any reason, without any notice or liability to you. We may terminate your account at any time for any or no reason, including if you violate any Renovating Moms policies. Upon termination of your use of the Renovating Moms Platform, certain provisions will survive termination where required in support of instituting or defending legal action by Renovating Moms or other affected parties.
• Feedback. We welcome your feedback and suggestions about how to improve the Renovating Moms Platform. Feel free to submit feedback at feedback@renovatingmoms.com. By submitting feedback in this or in any other manner to us, you grant us the right, at our discretion, to use, disclose and otherwise exploit the feedback, in whole or part, without any restriction or compensation to you.

1.2. Your Content.

• Definition of Your Content. The Renovating Moms Platform enables you to post materials, including without limitation photos, profile pictures, messages, comments, proposals, instructions and to-do lists. You may also post reviews of third-party service providers, third-party products, or third-party services. All materials that you post on the Renovating Moms Platform will be referred to collectively as “Your Content.“
• License and Permission to Use Your Content. You hereby grant to us and our affiliates, licensees and sub-licensees, without compensation to you or others, a non-exclusive, perpetual, irrevocable, royalty-free, fully paid-up, worldwide license (including the right to sublicense through multiple tiers) to use, reproduce, process, adapt, publicly perform, publicly display, modify, prepare derivative works, publish, transmit and distribute Your Content, or any portion thereof, throughout the world in any format, media or distribution method (whether now known or hereafter created) for the duration of any copyright or other rights in Your Content. Such permission will be perpetual and may not be revoked for any reason, to the maximum extent permitted by law. You further agree that we may use Your Content in any manner that we deem appropriate or necessary.
• Ownership. We acknowledge and agree that you, or your licensors, as applicable, retain ownership of any and all copyrights in Your Content, subject to the non-exclusive rights granted to us in the paragraph above, and that no ownership of such copyrights is transferred to us under this Agreement. Further, with respect to Your Content in the form of photos, and subject to Renovating Moms product and user experience considerations: (a) we will use commercially reasonable efforts to maintain the attribution of such photos as submitted by you, and (b) we will not license or sublicense to third parties’ individual photos or collections of photos, except in each case for Renovating Moms Business Purposes. “Renovating Moms Business Purposes” means any use in connection with a Renovating Moms-branded or co-branded website, application, publication or service, or any use which advertises, markets or promotes the Renovating Moms Platform, the services or the information it contains or Renovating Moms. Renovating Moms Business Purpose specifically includes the use of Your Content on the Renovating Moms Platform in connection with features and functions offered by Renovating Moms to our users that enable them to view and interact with Your Content.
• Your Responsibilities for Your Content. By posting, uploading, or submitting Your Content on the Renovating Moms Platform, you represent and warrant to us that you have the ownership rights, or you have obtained all necessary licenses or permissions from any relevant parties, to use Your Content in this manner. This includes obtaining the right to grant us the rights to use Your Content in accordance with this Agreement. You are in the best position to judge whether Your Content is in violation of intellectual property or personal rights of any third-party. You accept full responsibility for avoiding infringement of the intellectual property or personal rights of others in connection with Your Content. You are responsible for ensuring that Your Content does not violate Renovating Moms’ policies or any applicable law or regulation. You agree to pay all royalties, fees, and any other monies owed to any person by reason of Your Content.
• Limits. We reserve the right to remove Your Content, in whole or part, for any reason (which may include a reported violation of any of our policies or applicable law) submitted by you for any reason without notice.  We do not guarantee that we will publish all of Your Content. If you seek to publish a review, the requirements will be governed by our Review Policy.

1.3. Our Content and Materials.

• Definition of Our Content and Materials. All intellectual property in or related to the Renovating Moms Platform (specifically including, but not limited to, our software, the Renovating Moms marks, the Renovating Moms logo, and Renovating Moms buttons, badges, and widgets, but excluding Your Content), is the property of Renovating Moms Inc., its subsidiaries and affiliates or its licensors (“Our Content and Materials“).
• Our License to You. Subject to these Terms of Use, including the restrictions below, we grant you a limited non-exclusive license to use and access Our Content and Materials in connection with your use of the Renovating Moms Platform. Except as expressly agreed to otherwise by us (such as your eligibility for creation of a Professional Profile or your entering into a vendor, seller, advertiser, Site Designer, or other agreement with us), your use of the Renovating Moms Platform must be limited to personal non-commercial use. We may terminate this license at any time for any reason. Except for the rights and license granted in these terms, we reserve all other rights and grant no other rights or licenses, implied or otherwise.
• No Endorsement or Verification. Please note that the Renovating Moms Platform enables access to third-party content, products, and services, and it offers interactions with third-parties that we do not control. We assume no responsibility for, nor do we endorse or verify the content, offerings or conduct of third-parties (including but not limited to the products or services offered by third-parties or the descriptions of the products or services offered by third-parties). For example, Renovating Moms does not conduct background checks or otherwise vet the RM Pros listed on the Renovating Moms Platform, you should rely on community reviews as a vetting process.  Participation or availability on the Renovating Moms Platform does not amount to endorsement or verification by us. We make no warranties or representations with respect to the accuracy, completeness or timeliness of any content posted on the Renovating Moms Platform by anyone.
• Restrictions. Except as expressly provided in these Terms, you agree not to use, modify, reproduce, distribute, sell, license, reverse engineer, decompile, or otherwise exploit Our Content and Materials without our express written permission. Renovating Moms’ permission to you for your use of the Renovating Moms Platform expressly excludes commercial use by you of any information concerning product descriptions or professional listings for the benefit of another merchant. You are expressly prohibited from any use of data mining, robots, or similar data gathering and extraction tools in your use of the Renovating Moms Platform. You may view and print a reasonable number of copies of web pages located on the Renovating Moms Platform for your own personal use, provided that you retain all proprietary notices contained in the original materials, including attribution to Renovating Moms.
• Ownership. You acknowledge and agree that the Renovating Moms Platform and Renovating Moms marks will remain the property of Renovating Moms. The content, information and services made available on the Renovating Moms Platform are protected by copyright and other laws, and you acknowledge that these rights are valid and enforceable. You acknowledge that you do not acquire any ownership rights by using the Renovating Moms Platform.

1.4. Other Offerings on the Renovating Moms Platform.

• Embed Tool. If you are a user of an embed tool, which enables you to link to content on the Renovating Moms Platform, you understand and agree that we cannot guarantee that the content, which originates from third-parties, is non-infringing or will be free from claims about infringement. Such third-party content may be subject to takedown by us at any time, in accordance with our policies, if we receive a notice of infringement.
• Third-Party Services. You may be provided the opportunity on the Renovating Moms Platform to purchase services that are offered by third parties (collectively “Third-Party Services“), including those offered by professionals registered with Professional Profiles on the Renovating Moms Platform. The availability of any Third-Party Services on the Renovating Moms Platform does not imply our endorsement of the Third-Party Services.
• Third-Party Sites. The Renovating Moms Platform may contain links to other websites (the “Third-Party Sites“) for your convenience. We do not control the linked websites or the content provided through such Third-Party Sites. Your use of Third-Party Sites is subject to the privacy practices and terms of use established by the specific linked Third-Party Site, and we disclaim all liability for such use. The availability of such links does not indicate any approval or endorsement by us.

1.5. Reporting Violations of Your Intellectual Property Rights, Renovating Moms Policies, or Applicable Laws.

We have a special process for reporting violations of your intellectual property rights or other violations of Renovating Moms policies or applicable laws.

• Copyright and Trademark. If you believe content on the Renovating Moms Platform infringes your intellectual property rights, please email us with details of the alleged infringement and proof of your ownership of such rights for our assessment and removal of the subject content.
• Reports of Other Violations. If you believe content on the Renovating Moms Platform violates Renovating Moms’ acceptable use, prohibited products or otherwise violates applicable law, kindly email us on feedback@renovatingmoms.com to advise the alleged violation for our consideration.

We have no obligation to delete content that you personally may find objectionable or offensive. We endeavor to respond promptly to requests for content removal, consistent with our policies described above and applicable law.

1.6. Disclaimers and Limitations of Liability.

PLEASE READ THIS SECTION CAREFULLY SINCE IT LIMITS THE LIABILITY OF RENOVATING MOMS PLATFORM TO YOU.

The “Renovating Moms Platform” means Renovating Moms Platform  and any subsidiaries, affiliates, related companies, suppliers, licensors and partners, and the officers, directors, employees, agents and representatives of each of them. Each provision below applies to the maximum extent permitted under applicable law:

• We are providing you the Renovating Moms Platform services, information, products, product descriptions, and third-party content on an “as is” and “as available” basis, without warranty of any kind, express or implied. Without limiting the foregoing, the Renovating Moms Platform expressly disclaim any and all warranties and conditions of merchantability, title, accuracy and completeness, uninterrupted or error-free service, fitness for a particular purpose, quiet enjoyment, and non-infringement, and any warranties arising out of course of dealing or trade usage.
• The Renovating Moms Platform make no promises with respect to, and expressly disclaim all liability, to the maximum extent permitted by law, for: (i) content posted by any third-party on the Renovating Moms Platform, (ii) the product descriptions or products, (iii) third-party sites and any third-party product or service listed on or accessible to you through the site, and (iv) the quality or conduct of any third-party you encounter in connection with your use of the site.
• You agree that under the maximum extent permitted by law, the Renovating Moms Platform will not be liable to you under any theory of liability. Without limiting the foregoing, you agree that the Renovating Moms Platform specifically will not be liable for (i) any indirect, incidental, consequential, special, or exemplary damages, loss of profits, business interruption, reputational harm, or loss of data (even if the Renovating Moms Platform have been advised of the possibility of such damages or such damages are foreseeable) arising out of and in any way connected with your use of, or inability to use, the Renovating Moms Platform or products. your use of the Renovating Moms Platform products, information, or services is at your sole risk.

1.7. Indemnification.

You agree to fully indemnify, defend, and hold the Renovating Moms Platform and their owners, officers, employees, consultants, and other representatives, harmless from and against any and all claims, damages, losses, costs (including reasonable attorneys’ fees), and other expenses that arise directly or indirectly out of or from: (a) your breach of any part of this Agreement, including but not limited to its acceptable use or prohibited products; (b) any allegation that any materials you submit to us or transmit to the Renovating Moms Platform infringe or otherwise violate the copyright, patent, trademark, trade secret, or other intellectual property or other rights of any third party; (c) your activities in connection with the Renovating Moms Platform or other websites to which the Renovating Moms Platform is linked; and/or (d) your negligent or willful misconduct.

1.8. Dispute Resolution.

If you have a dispute with Renovating Moms, you agree to contact us to attempt to resolve the issue informally first. If we are not able to resolve the dispute informally, then this section will govern any legal dispute that arises out of or relates to the Renovating Moms Platform or involves our services.

• Binding Arbitration. You and Renovating Moms agree that any dispute, claim or controversy arising out of or relating to this Agreement or to your use of the Renovating Moms Platform (collectively “Disputes“) will be settled by binding arbitration, except that each party retains the right to seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of a party’s copyrights, trademarks, trade secrets, patents, or other intellectual property rights. Notwithstanding the foregoing, you may bring a claim against Renovating Moms in “small claims” court, instead of by arbitration, but only if the claim is eligible under the rules of the small claims court and is brought in an individual, non-class, and non-representative basis, and only for so long as it remains in the small claims court and in an individual, non-class, and non-representative basis.
• Class Action Waiver. You and Renovating Moms agree that any proceedings to resolve Disputes will be conducted on an individual basis and not in a class, consolidated, or representative action. This means that, in connection with any Dispute, you and Renovating Moms both agree to waive the right to participate as a plaintiff as a class member in any class action proceeding. Further, unless you and Renovating Moms agree otherwise in writing, the arbitrator in any Dispute may not consolidate more than one person’s claims and may not preside over any form of class action proceeding.
• Arbitration Administration and Rules.
  Arbitration will be conducted in terms of the South African Arbitration Act 42 of 1965.
• If you have a dispute with another user on the Renovating Moms Platform or with any third party, you agree that Renovating Moms is under no obligation to become involved. In the event that you have a dispute with one or more other users, you release Renovating Moms, its owners, officers, employees, agents, and successors from claims, demands, and damages of every kind or nature, known or unknown, suspected or unsuspected, disclosed or undisclosed, arising out of or in any way related to such disputes and/or the Renovating Moms Platform. As part of this release, you expressly waive any protections (whether statutory or otherwise) that would otherwise limit this release to only include those claims that you may know or suspect to exist in your favor at the time of agreeing to this release.

1.9. Communications.

You are not required to agree to receive promotional text messages, calls or pre-recorded messages as a condition of using the Renovating Moms Platform. By electing to submit your phone number and/or email address to us and agreeing to these Terms, you agree to receive communications from the Renovating Moms Platform, including via text messages, emails, calls, pre-recorded messages, and push notifications, some of which may be generated by automatic telephone dialing systems. These communications include, for example, operational communications concerning your account or use of the Renovating Moms Platform, updates concerning new and existing features on the Renovating Moms Platform, communications concerning promotions run by us or third parties, and news relating to the Renovating Moms Platform and industry developments. Standard text message charges applied by your telephone carrier may apply to text messages we send. If you submit someone else’s phone number or email address to us to receive communications from the Renovating Moms Platform, you represent and warrant that each person for whom you provide a phone number or email address has consented to receive communications from Renovating Moms.

If you wish to stop receiving promotional emails or promotional text messages, it is your obligation to opt-out or unsubscribe using your settings.

1.10. Miscellaneous.

• Supplemental Terms for Certain Services. Certain services offered on the Renovating Moms Platform may require you to enter into a separate agreement and/or be subject to additional terms. For example: placement of advertisements, participation in brand services or offering products for sale each of which may require you to enter into a separate agreement with terms specific to that service. In the event of any conflict between this Agreement and the terms of that separate agreement, the terms of this Agreement will override.
• Controlling Law and Jurisdiction. This Agreement will be interpreted in accordance with the laws of the Republic of South Africa.
• Changes. We reserve the right to:
      i. change or add to the terms of this Agreement, consistent with applicable law;
      ii. change the Renovating Moms Platform, including eliminating or discontinuing any information or services or other features in whole or in part; and
      iii. deny or terminate your Renovating Moms account, or use of and access to the Renovating Moms Platform.
  If we make material changes to the Terms, we will notify you through the Renovating Moms Platform, by email, or by other means. You agree that your continued use of the Renovating Moms Platform after such changes become effective constitutes your acceptance of the changes. If you do not agree with any updates to this Agreement, you may not continue to use the Renovating Moms Platform. Be sure to return to this page periodically to ensure your familiarity with the most current version of the Terms of Use. Any changes to the Terms will be effective on a going forward basis.
• Languages. In the event of this Agreement being translated into other languages, the English version of this Agreement will be the binding version and all communications, notices, arbitrations and other actions and proceedings relating to this Agreement.
• Assignment. No terms of this Agreement, nor any right, obligation, or remedy hereunder is assignable, transferable, delegable, or sub licensable by you except with Renovating Moms’ prior written consent, and any attempted assignment, transfer, delegation, or sublicense shall be null and void. Renovating Moms may assign, transfer, or delegate this Agreement or any right or obligation or remedy hereunder in its sole discretion.
• Waiver. Our failure to assert a right or provision under this Agreement will not constitute a waiver of such right or provision.
• Headings. Any heading, caption, or section title contained is inserted only as a matter of convenience and in no way defines or explains any section or provision hereof.
• Further Assurances. You agree to execute a hard copy of this Agreement and any other documents, and take any actions at our expense that we may request to confirm and effect the intent of this Agreement and any of your rights or obligations under this Agreement.
• Entire Agreement and Severability. This Agreement supersedes all prior terms, agreements, discussions and writings regarding the Renovating Moms Platform and constitutes the entire agreement between you and us regarding the Renovating Moms Platform. If any part of this Agreement is found to be unenforceable, then that part will not affect the enforceability of the remaining parts of the Agreement, which will remain in full force and effect.
• Survival. The following provisions will survive expiration or termination of this Agreement: Your Content, Restrictions, Ownership, Disclaimers and Limitations of Liability, Indemnification, Dispute Resolution and Miscellaneous.

PRIVACY POLICY

Welcome to Renovating Moms, an online platform connecting a community on all things home. We connect home owners with service providers and with each other to inspire, connect and share supporting each other to improve one of their biggest financial and emotional investments – their homes.  

This Privacy Policy describes what personal information we collect, how we use this information, how this information may be shared, and what choices and rights you have with respect to this information. Access and use of our Platform is subject to this Privacy Policy.

Our “Platform” is made up of Renovating Moms, and other sites, apps, products, and services on which this Privacy Policy is posted and that are Renovating Moms-branded or operated by the Renovating Moms group, including our plug-ins, embedded content made available on other sites, and browser extensions.

The terms “we,” “us,” or “our” refer to the Renovating Mom Platform. By “you,” we are referring to visitors and users of any part of our Platform and reference to a particular gender includes all other genders.

2.1. Collection of Information

We collect personal information that you provide us, from third parties, and automatically when you use our Platform. We collect information associated with your device, maybe using cookies and similar technologies. We may also receive information about your location.

Information You Provide Us

We collect information that you provide us, including your account and profile information, content you submit or post to our Platform, your communications, and information you provide to us as part of surveys and contests.

Account and Profile Information. When you create an account on our Platform, we collect information you provide us, like your name, email address, interests, gender, age, and profile information. If you are a professional, you may also provide us information related to your business, including a business description and areas served.

Content You Submit. We collect information and content that you submit, post to, or create in our Platform, including your photos, comments, reviews, searches, photo notes, discussions, project details and costs, style preferences.

Purchases. If you purchase or sell products or services or make or receive payments within our Platform, we collect certain information in order to complete your purchases, sales, and payments, such as your phone number, address, and payment method (for example, credit card or bank account information).

Communications. When you communicate with us (via email, phone, through our Platform, or otherwise) and when you use our Platform to communicate with others, we may record, monitor, or otherwise collect details about your communications (including call time, and call duration). Otherwise, to the extent you communicate with professionals, sellers, and other users outside our Platform, those communications are not subject to this Privacy Policy.

Surveys and Contests. If you participate in our surveys, contests, or promotions, we will collect the information you provide to us.

Information from Others

We collect information that others make available to us, including information from other platforms, publicly available information, information from other users of our Platform, information from our partners, service providers, and corporate affiliates, and information from third-party sites.

Other Platforms. We may receive information about you from third-party platforms when you allow the third-party platform to share this information with us or allow Renovating Moms to obtain this information from the third party. For example, you may sign-up for our Platform through Facebook, Google, or Apple; upload your contacts from your third-party email service; use our Platform to manage and send communications (e.g., email or messages).

Publicly Available Information. If you are a professional or seller, we may collect information about you from publicly available sources and where permitted by applicable law or with your permission, make it available as part of our Platform. For example, we may receive your name and contact information from industry associations and dealer networks in which you participate and display your affiliation with these organizations. We also may collect and display the details of any license you have using publicly available records.

Other Users and Customers. Others may post content on our Platform that includes information about you (for example, as part of photos, stories, and reviews) or provide us your information in connection with using our Platform (e.g., to manage their business, organize photoshoots of their projects, participate in referral programs, and to advertise through our Platform). In order to enhance the quality of our Platform, professionals and sellers on our Platform may provide us information about your engagement with them, including whether you have contacted them or responded to them, whether your project has been completed, and whether you have received a product you have ordered. If you are a professional or seller, Platform users and visitors may provide us with feedback and public reviews about you.

Our Partners and Service Providers. We may receive information about you from our partners and service providers. For example, our payment processors may update your payment information, advertising partners may help us send communications to your address, and third parties may help us prevent fraud by verifying your contact information. 

Renovating Moms Platform. Subject to the privacy policies of our corporate affiliates and in accordance with applicable laws, we may receive information about you from them.

Automatically Collected Information

Each time you access the Platform, information is sent to our server by your Internet browser or app and stored in our log files. We may collect information about your use of our Platform, including your search activity, the pages you view, the date and time of your visit, and if you use our browser extensions, the content you interact with on third-party sites (for example, if you save an image from a third-party site to your Renovating Moms account), and how you navigate and interact with a page or screen. We also collect information that your device provides to us in connection with your use of our Platform, such as your browser type, type of device, browser language, IP address, mobile carrier, unique device identifier, and requested and referring URLs.

Cookies and Similar Technologies

We may use cookies and similar technologies in connection with your use of our Platform to collect information related to what you see and interact with on our Platform and other Platform access and use. Please see our Cookie Policy  for more information on our use of cookies and how to accept or opt-out of cookies, but please note that unless required by law, we do not change system behavior within our Platform in response to browser requests not to be tracked.

Location Information

We will receive your device’s location if you enable this through your browser or mobile device. We may infer your general location from your IP address. You may also choose to provide us your location information by inputting this information in our Platform, including in your Renovating Moms settings.

2.2. Use of Information

We use the personal information we collect to provide, support, and personalize our Platform and to communicate with you about our Platform (on and off our Platform). The ways we do this include the following:

• to provide and improve our Platform and its features and functionality, including to display content you post publicly, fulfill your purchases through our Platform, process, store, and deliver your communications; to provide customer service and support; to respond to your inquiries or requests; to back-up our systems; and to improve the security of our Platform;
• to evaluate use of our Platform for our business purposes and to provide and improve our products and services, including new and co-branded products and services and our Platform’s functionality;
• to possibly personalize your experience, such as tailoring the content and information made available to you and our support services;
• to display relevant advertising (on our Platform and third-party sites) for us and other businesses and to evaluate the success of such advertising;
• to provide feedback to professionals and sellers on our Platform;
• to communicate with you as described in our agreements with you (for example, the Renovating Moms Terms of Use) or this Privacy Policy;
• to prevent fraud and to maintain a quality experience for our business purposes or legal reasons, including to filter for spam and communications that violate our agreements with you (for example, the Renovating Moms Terms of Use);
• to enforce compliance with our agreements with you where we become aware of any breach (for example, the Renovating Moms Terms of Use) and applicable law; to comply with our legal obligations; to prosecute or defend a lawsuit, arbitration, or similar legal proceeding; to respond to lawful requests by public authorities (including law enforcement requirements);
• to perform research and analysis for our business purposes; and
• to award badges and similar designations and if you decide to participate, to administer surveys, contests, and promotions.

If you provide us information about your contacts (for example, when you sign up for our Platform through Facebook), in order to facilitate a more connected experience, we may inform your contacts who have accounts on our Platform that you also have joined our Platform and follow them on your behalf so that you may view their public activities on our Platform.

We may use your communications generally for quality assurance purposes and training and to improve our products and services. We may use your communications to understand and help manage the quality of requests received, and responses sent, by professionals and sellers on our Platform and to provide them with feedback. We may use automated technology to review your communications and improve user experience.

We may use your log-in information, cookie information, device information, IP addresses, and other information to identify you and log your use across devices, our Platform, and third-party sites may use this information to personalize your experience on our Platform. 

For your convenience, we and our payment processors will store information about the payment method you use in connection with the Platform. Note that while our payment processors may store your complete credit card number, Renovating Moms does not. You may remove or change your payment method on Renovating Moms through your settings. 

Your membership of Renovating Moms is an implied acknowledgement of our right to utilize your information and not in breach of the POPI act.

2.3. Sharing Your Information

We do not rent or sell your personal contact information (such as your email address associated with your account registration) to third parties to use for their direct marketing purposes. We share personal information in the following ways:

Platform Visitors and Users

One of the main purposes of having a Renovating Moms account is to share home renovation and design ideas with others. Through Renovating Moms, others have the ability to find, contact, view, and follow your profile and public activity on Renovating Moms (for example, if you “like” content on our Platform or if you create an album and do not mark it private) and link it to your username. You can customize your Renovating Moms profile and whether users can see your content through your Renovating Mom settings. Other than your proprietary content that you generate in or upload to our Renovating Moms Platform, your Renovating Moms content (for example, photos, comments on others’ photos, albums, discussions, and social media profiles), followers, and others you follow are publicly viewable on the Platform and open to comments by other Renovating Moms users. If you are a professional or seller on Renovating Moms, we may also display the following information in order to help visitors and users evaluate you: your last visit to Renovating Moms, aggregated information on our Platform about your Platform activity (e.g. response rate), and information that is publicly available from third parties. We have policies that place restrictions on Platform visitors’ and users’ use of information and content you choose to make available publicly through the Platform.

Professionals, Sellers, and Other Businesses on our Platform

Professionals and sellers that participate on the Renovating Moms Platform may view your public activities on our Platform and receive feedback you provide to us about your engagement with them. In addition, a professional or seller can view your public activities on our Platform that are interactions with their content (for example, that you added one of their photos to your non-private timeline on a particular date, as identified by the username for your profile and any photo or public identifiers you provide for your profile). The business cannot see your non-public account information (for example, email address) or see private activity (for example, if your photo album is private). We ask professionals, sellers, and advertising businesses on our Platform to limit the use of your information to the reasons for which the information was provided.

Service Providers and Partners

We may share your information with service providers and partners as reasonably needed for our uses described in this Privacy Policy. We ask our service providers to limit their use of that information for use on behalf of Renovating Moms and for improving their services and products (in a de-identified form if legally required). Only if you specifically agree to share your contact information with a third-party partner, for example, as part of a contest or promotion we sponsor with such third-party, will we share your contact information with that third-party partner for their direct marketing purposes.

In addition, we may share information about you with third-party platforms when you allow the third-party platform to receive this information from us or allow Renovating Moms to share this information with the third party. Our Platform may include third-party social media features. When these features are displayed on our Platform, they are operated or hosted by third parties and are subject to their own privacy policies instead of this Privacy Policy. For example, you may sign-up for our Platform through Facebook, Google, or Apple.

Advertisers and Ad Networks

We may use advertising networks and partners to serve advertisements for us and other businesses, including interest-based advertising, on third-party sites and to assist us in evaluating the effectiveness of our advertising. We may also work with advertising networks and partners to serve ads on our Platform and to communicate with you at the addresses they have for you. We may provide advertising networks, advertising partners, and businesses advertising on our platform with aggregate information but other than hashed information or device identifiers, we do not disclose your name, contact information, or other personal information. To opt-out of the use of your information for this purpose, please send a request as provided under the Contact Us section.

We and the businesses advertising on our Platform, advertising networks, and advertising partners may also use cookies or similar technologies to track your activities on our Platform and other online properties in order to provide you with tailored ads across websites, apps, and devices and to understand how those ads perform. Corporate Affiliates and Business Transfers

We may share information from or about you with (a) joint ventures or other companies in the Renovating Moms group, or (b) a potential or actual acquirer, successor, or assignee as part of any reorganization, merger, sale, joint venture, assignment, transfer, or other disposition of all or any portion of our business, assets, or stock (including in bankruptcy or similar proceedings). In these cases, their use will be subject to this Privacy Policy.

Legal Obligations

We may disclose information from or about you, as required or permitted by applicable law, if we believe that such disclosure is reasonably necessary to (a) comply with legal process and law enforcement instructions and orders, such as a search warrant, subpoena, statute, judicial proceeding, or other legal process served on us, a service provider, or a partner (which may include disclosure to law enforcement, courts, or governmental authorities); (b) prevent, investigate, or identify possible wrongdoing in connection with our Platform; (c) protect our rights, reputation, property, or that of our visitors, users, corporate affiliates, or the public; or (d) enforce compliance with our agreements with you (for example, the Renovating Moms Terms of Use).

2.4. Communications

An essential part of our services that you sign up for when you create an account on our Platform is to receive communications from the Renovating Moms group through email and our Platform. If you use our app or provide us with your cell phone number, these communications also include text messages and push notifications. We communicate with you about your account, privacy, and interactions with your content (for example, if others respond to your comment, or if you earn a badge on our Platform). We might also ask for your feedback about your experience in connection with our Platform or about your home renovation and design plans. In accordance with applicable law, we may send you marketing communications (e.g., with tips, offers, and similar services) from the Renovating Moms group. These communications may feature us, our Platform, co-branded products and services, professionals, sellers, and other businesses on our Platform.

If you provide us your phone number, we may call and otherwise contact you to help you with using the Platform (e.g., to discuss your home remodeling or design project, to find professionals, or to assist with your order or if you are a professional, to find products or to provide you tips about your professional profile). If you are a professional or other business, we may use your contact information (whether publicly available or provided to Renovating Moms) to call and otherwise contact you about our Platform, including to market and sell our products or services or those available on our Platform.

You may change your communication preferences at any time through your Renovating Moms settings if you have a Renovating Moms account, and you may also opt-out of similar types of marketing emails from us directly through the email.  You may opt-out of sales and marketing phone calls from us by letting us know during the call or by emailing us at privacy@renovatingmoms.com. Please be aware that you cannot opt-out of receiving account- and privacy-related messages from us. 

Our Platform also allows you and others to send messages in our Platform, share content with others outside our Platform, and if you make your contact information available, for others to contact you outside of our Platform.

2.5. Your Choices and Rights

By registering as a member on the Renovating Mom Platform, you understand your right to privacy and its protection under the Protection of Personal Information Act, 2013 which also provides for you to object at any time to the processing of such personal information by us. After receipt of an objection, we must immediately cease to process such information unless legislation requires us not to do so. In the absence of receiving a written objection, you will be deemed to have given your consent to processing your personal information.  We may ask you to verify your identity in order to help us respond to your request securely and efficiently.

Even where not legally required, we will use reasonable efforts to complete requests to access or delete your personal information. You may request to receive a copy of your Renovating Moms information by emailing privacy@renovatingmoms.com. You may access your Renovating Moms information by contacting us as provided in the Contact Us section. To request permanent deletion of your personal information, please contact us as described in the Contact Us section.

To edit your personal information, you can manage your profile on our Platform, as well as your Renovating Moms settings. You may also contact us about correcting or updating your personal information (including your marketing preferences) by emailing us on privacy@renovatingmoms.com. We will consider your request in accordance with applicable laws.

2.6. Account Termination and Data Retention

Unless you are a professional or seller on Renovating Moms, you can deactivate your Renovating Moms account at any time by going to your Renovating Moms settings. To deactivate your account as a professional or seller on Renovating Moms, please email us at pros@renovatingmoms.com. When you deactivate your account, you will cease to provide ongoing or future data to us that is associated with your account. Your Renovating Moms profile will no longer be accessible on the Platform but in accordance with applicable law and the Renovating Moms Terms of Use, your photos, reviews, and other content may still be available through our Platform. In order to request permanent deletion of the personal information associated with your account, please email us at privacy@renovatingmoms.com.

We will keep your personal information only for as long as necessary to fulfill the purposes for which we are processing your personal information unless the law permits or requires us to retain your personal information for a longer period. 

2.7. Children

Our Platform is intended for general audiences and is not directed to children under 18. We do not knowingly collect personal information from children under 18. In the event that we learn that we have collected personal information from a child under age 18, we will take appropriate steps to delete that information. If you become aware or believe that a child has provided us with personal information, please contact us at privacy@renovatingmoms.com.

2.8. Data Security

We use reasonable and appropriate measures to protect your personal information from loss, misuse, unauthorized access, disclosure, alteration, and destruction, taking into account the risks involved in the processing and the nature of the personal information.

2.9. Updates to this Privacy Policy

We may revise this Privacy Policy from time to time. The most current version of our Privacy Policy will govern our use of information about you. If we make material changes to our Privacy Policy, we will notify you by email or by posting a notice on our Platform or by other means, to offer you an opportunity to review the changes before they become effective. By continuing to access or use our Platform after those changes become effective, you are subject to the revised Privacy Policy.

PROFESSIONAL PROFILE POLICY

Home professionals (“Pros“) may elect to create a Renovating Moms Professional Profile. Subject to the Renovating Moms Terms of Use and this Professional Profile Policy, Pros can use the features made available on our Platform to promote their business.

Pros on Renovating Moms are expected to treat others with respect, be responsive to current and prospective clients, and conduct business in accordance with applicable laws and regulations.

By creating a Professional Profile (including by claiming an unclaimed Professional Profile), you acknowledge and agree to each of the following:

• Authorized Person. You are a principal or employee authorized to create a Professional Profile for the business. You are responsible for any and all activity on your account, including as a result of you choosing to share your account credentials, not keeping your account credentials confidential, or not keeping your account credentials updated.
• Accurate Information.
      i. You will provide accurate, truthful, and complete information regarding your business, and keep all business information up to date;
      ii. You will create only one Professional Profile for your business;
      iii. You will pick a business category that accurately describes your products and services; and
      iv. Professional Profiles created for business categories not supported by Renovating Moms will be removed without notice.
• License Information. If your profession or business requires licensure, you agree to provide all licensing information necessary to list or advertise your business online on Renovating Moms. In addition, you represent that any licensing information you provide is accurate and up to date.
• Projects. You agree that any Projects and photos posted on your Professional Profile represent your own work, and you will not claim credit for the work of others.
• Affiliations. Renovating Moms may enable you to display your affiliation with certain trade associations relevant to your business. You agree that you will only choose those organizations with which you are actually affiliated for display on your Professional Profile, and promptly remove any affiliations if no longer current. You agree that in certain circumstances Renovating Moms may display your affiliation with certain trade association partners on your Professional Profile on your behalf, e.g. upon your supplied evidence of verification of membership by the trade association.
• No Guaranteed Placements. The appearance of your Professional Profile in Renovating Moms search results is not guaranteed and is dependent on a number of factors, including without limitation the popularity and volume of photos, reviews, and user interactions. Renovating Moms does not guarantee specific placements on Renovating Moms except as part of paid marketing packages. 
• Reviews. Customers may review your business on your Professional Profile. You understand and agree that while all reviews must follow our Review Policy, Renovating Moms does not remove negative reviews that do not violate our Review Policy, regardless of whether a Pro is a paying customer or not, except as may be required by law. If you attempt to create new or additional Professional Profiles for the same business, we reserve the right to link your prior reviews to your new or additional Professional Profiles.
• Removal; Termination. Pursuant to our Terms of Use, if you deactivate or permanently delete your Professional Profile, subject to applicable law, any postings, reviews, photos, or comments you submitted prior to deactivation or deletion may remain published on the Platform after deactivation or deletion. Renovating Moms does not actively monitor the activities of our professionals, whether on or off of our Platform. However, Renovating Moms reserves the right to remove your Professional Profile, deactivate your account, terminate any or all agreements you have with Renovating Moms, or terminate any or all services that Renovating Moms provides to you if we believe you have engaged in criminal behavior (including if you have been indicted of a crime); if you have engaged in other illegal or fraudulent behavior related to your business (including if you have advised that you are properly licensed and we find out that you are not); if you have engaged in abusive, harassing, or threatening behavior on our Platform or towards Renovating Moms or its personnel; or if you otherwise violate our Terms of Use or other relevant policy or this Professional Profile Policy. Renovating Moms may maintain a copy of the information associated with your business on the Renovating Moms Platform for 90 days after the deactivation or deletion of your Professional Profile. Unless permanent deletion of the information associated with your business on the Renovating Moms Platform is requested by you, Renovating Moms may retain that information for a longer period of time at its discretion.
• Personal Data. Personal data collected with respect to the Professional will be handled by Renovating Moms in accordance with the Renovating Moms Privacy Policy, which is incorporated by reference. To the extent that you receive personal information through our Platform (“User Data”), you may use the User Data only for the intended purpose for which it was provided, i.e. to respond to the applicable person in a timely manner (including to provide information about your services and provide the service requested) or as otherwise authorized by the individual. You shall protect the confidentiality of User Data and use appropriate security safeguards to protect User Data against unauthorized or unlawful processing or use of User Data and against accidental loss, destruction, alteration, disclosure of, or access to User Data. You may share such User Data only to the extent authorized by the person to which such Personal Data relates or to your sub-contractors, provided that you are responsible for ensuring the subcontractors’ compliance with this provision. Without limiting the foregoing, you shall not sell User Data, whether for money or other valuable consideration. You will ensure that your use of User Data (including your communications with Renovating Moms users by email, phone, text, or otherwise) is at all times compliant with all applicable laws (including with respect to the period with which you retain User Data) and that you honour requests by individuals exercising their rights under applicable law (e.g. with respect to not contacting the individual further, data deletion, or data access). If a person with whom you have no business relationship does not affirmatively respond to or is not otherwise receptive to your communications, you agree that you will cease communicating to such person through the Platform after a reasonable number of outreaches. If you decline or are not interested in an inquiry from a homeowner, Renovating Moms reserves the right to remove that homeowner’s User Data from your account. You understand and agree that you are the sender of, and responsible for, any of your communications through the Platform, and Renovating Moms is not the sender. The Platform is not intended for transmitting payment card information or other sensitive information, except where expressly prompted by Platform payment features; however, Renovating Moms has no obligation to monitor or restrict such information from being transmitted in the Platform. If you receive any privacy inquiry or complaint from an individual, regulator or other party related to the use of User Data, you will promptly inform Renovating Moms of such inquiry or complaint and will cooperate reasonably and in good faith to respond to such inquiry or complaint. Renovating Moms limits the access to the information associated with your business on the Renovating Moms Platform on a need-to-know basis (by policy or technical controls) for the uses identified in the Renovating Moms Privacy Policy.
• Communications Preferences. When you create an account on Renovating Moms, please note that any prior communications preferences you may have conveyed to Renovating Moms will not be transferred to your Renovating Moms account. We reserve the right to communicate with you using the contact information you provide or that is publicly or commercially available, including to provide you with information about our services and products and with tips and offers.
• User Disputes. You agree that you are solely responsible for your agreements or interactions with any Renovating Moms user, and we will have no liability or responsibility in connection with such agreements or interactions. We reserve the right, but have no obligation, to become involved in any way with disputes between you and any Renovating Moms user.
• Your Content. To enable Renovating Moms to display your Professional Profile and otherwise provide exposure for your work, we need you to provide us with content and materials about your business (“Customer Content”). You retain all ownership of your Customer Content that you provide to Renovating Moms and you grant Renovating Moms a license to use that Customer Content as set out in the Renovating Moms Terms of Use so that Renovating Moms can display your Professional Profile and promote the Renovating Moms Platform, Renovating Moms or your work. We need you to grant Renovating Moms that license and certain other rights detailed in the Renovating Moms Terms of Use so that technical actions we take in operating the Renovating Moms Platform are not considered legal violations. We also use service providers, such as web hosting services, who need to receive the content in order for us to operate the Renovating Moms Platform. In order to maintain a consistent experience for others in the community who may view our editorial articles that feature your photos or who may have saved your photos to their albums, your photos and public content remain on our Platform after account closure.

REVIEW POLICY

Renovating Moms may enable you to post Reviews.  Reviews are considered Your Content.

By posting a Review, you acknowledge and agree that:

1. You are not (a) a director, employee, officer, or principal  (“Interested Party”) of the business whose products or services are the subject of the Review, (b) an Interested Party of a competitor of the business or individual whose products or services are the subject of the Review; or (c) related in any way, including by blood, adoption or marriage, to the business or individual whose products or services are the subject of the Review;
2. Your Review is based upon your first-hand experience as a client with the products, or business or individual whose services, are the subject of the Review and not correspondence or interactions as a potential client;
3. Your Review is accurate, truthful and complete;   
4. Your Review does not violate our policies and beliefs, including through libelous, defamatory, threatening, harassing, invasive of privacy, abusive, tortious, hateful, discriminatory, pornographic or obscene content; as determined by Renovating Moms in our sole and absolute discretion;
5. If you have received monetary compensation or other incentive to write and submit a Review, it will be clearly and conspicuously stated in the text of your Review, even if the amount or value of such incentive is small;
6. You will not use the posting or removal of your Review to demand payment from any business or individual, except that bona fide refund requests made in connection with a bad customer experience are acceptable.
7. You are not the professional being reviewed and using another profile to submit a review for your business on behalf of another party;
8. Your review is strictly related to a project undertaken with the professional/company as stated in their Renovating Moms profile and does not include any references to a different company, even if it has been rebranded; 
9. Your review does not include any reference(s) to someone else’s comments/reviews;
10. Your review does not include any external links nor has reference(s) to promote other companies;
11. Only one person per household or company is reviewing the professional hired for the project.
